Welcome to Mochi Dolls Studio. By accessing or using our website at mochidolls.com and purchasing our products, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use our services.

Apex Sync Global LLC (doing business as Mochi Dolls Studio) is a handcrafted doll studio. We design and hand-make original dolls sold exclusively through this website. All products are handmade to order or available in limited quantities.

2. Eligibility

You must be at least 18 years old to purchase from our website. By placing an order, you represent that you are 18 or older, or that you are purchasing under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.

3. Products

• All dolls are handmade originals. Minor variations in color, stitch, and appearance are expected and are a natural characteristic of handcrafted goods — not defects.
• Product photos are representative. Actual products may vary slightly in color depending on your screen calibration.
• All products are intended for display and collector use. They are not designed as toys for children under 3 years of age due to small parts that may pose a choking hazard.
• Limited edition and seasonal items are available only while supplies last. Listing a product does not guarantee availability.

4. Pricing and Payment

• All prices are listed in US Dollars (USD) unless otherwise stated.
• Prices are subject to change without notice. The price displayed at the time your order is confirmed is the price you will be charged.
• Payment is processed securely via Stripe, Inc. We accept major credit cards, debit cards, and other payment methods enabled by Stripe. We do not store any payment card information on our servers.
• By submitting an order, you authorize us to charge your selected payment method for the full order total, including any applicable taxes and shipping fees.
• In the event of a pricing error, we reserve the right to cancel affected orders and issue a full refund.

5. Orders and Cancellations

• An order is confirmed once you receive an order confirmation email from us.
• For in-stock items, cancellations may be requested within 24 hours of placing your order, provided the item has not yet shipped.
• Custom orders cannot be cancelled once confirmed, as materials are immediately allocated to your order.
• We reserve the right to cancel any order if we suspect fraud, if a product becomes unavailable, or if there is a pricing error. A full refund will be issued immediately in such cases.

6. EU Consumer Right of Withdrawal

If you are a consumer resident in the European Union, you have the right to withdraw from your purchase within 14 calendar days of receiving the goods, without giving any reason, in accordance with the EU Consumer Rights Directive. This right does not apply to:

• Custom-made or personalized goods produced specifically to your specifications
• Sealed items that have been opened and are not suitable for return due to health or hygiene reasons

To exercise this right, please notify us at shoylife1@gmail.com before the 14-day period expires. You must return the goods in their original condition at your own expense, unless the item was delivered in error or is defective.

7. Intellectual Property

All designs, photographs, artwork, text, and other content on this website are the exclusive intellectual property of Mochi Dolls Studio and are protected by applicable copyright and trademark laws. You may not reproduce, distribute, copy, modify, or sell any content without our express written permission.

Purchasing a physical product does not transfer any intellectual property rights. The physical item is yours; all design rights remain ours.

8. User Conduct

You agree not to use our website to:

• Engage in any unlawful activity or violate any applicable laws
• Submit false, misleading, or fraudulent information
• Attempt to gain unauthorized access to our systems or data
• Impersonate any person or entity

9. Disclaimer of Warranties

Our website and products are provided "as is" and "as available." We make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement, except as expressly required by applicable law.

10. Limitation of Liability

To the fullest extent permitted by applicable law, Mochi Dolls Studio shall not be liable for any indirect, incidental, special, punitive, or consequential damages arising out of your use of our website or products. Our total liability to you for any claim arising from these Terms shall not exceed the amount you paid for the specific product giving rise to the claim.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

11. Dispute Resolution

We encourage you to contact us first at shoylife1@gmail.com to resolve any dispute informally. We aim to respond within 48 hours and resolve all issues amicably.

If a dispute cannot be resolved informally, it shall be submitted to binding arbitration or, where not permitted, to the courts of competent jurisdiction as specified below.

EU consumers retain the right to bring proceedings before the courts of their country of residence and to use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to conflict of law principles. Any legal proceedings shall be conducted in the courts of that jurisdiction, except where mandatory consumer protection laws of your country of residence provide otherwise.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised "Last updated" date. Continued use of our website after changes constitutes your acceptance of the updated Terms. We recommend reviewing these Terms periodically.
